The Spanish Notary Public intervenes professionally in a multitude of legal acts and businesses, either because the law exceptionally requires them to be formalised in a public deed, as occurs in the case of the incorporation of companies, or, generally, because the law attributes very important effects to the notarial document, given the necessary impartiality, legal training, and the character that every Notary Public has as a public official. And so the notarial deed is enforceable, it is full proof of the date and the fact of its execution, it is a guarantee of the identity and full legal capacity of the persons who sign it and that it has been executed freely and voluntarily; and it is therefore a specially qualified document and as such is subject to registration in the Commercial Register or the Land Register, depending on the case.
